Below is a list of the general terms and conditions when booking a Faria Family Resort property.
Booking Policy
10% due at time of booking
50% of balance due 90 days prior to check-in
50% remaining due 30 days prior to check-in
For groups booking four or more units, 50% payment of rent is due at time of booking and is non-refundable. Full payment is required 120 before check-in.
Cancelation Policy
90 day notice is required – will incur an $89 cancellation fee
Less than 90 days are subject to a 20% cancellation fee of the reservation amount
Less than 60 days forfeit advance payment.
For reservations that consist of 2 units or an 8-14 night rental, a 120-day notice of cancellation is required prior to the arrival date, or a 20% cancellation fee of the rental rate will occur.
For large groups, part of a group or family reunions that consist of 3 units, a 6-month notice is required or a 20% cancellation fee applies to all units reserved.
For groups booking four or more units, or reservations longer than 14 days, a 50% payment of rental total is due at the time of booking and is refundable with an $89 cancellation fee per unit, up until 1 year from the check-in date.
Cancellation or early departure does not warrant any refund of rent. Once inside the 90-day period, modifying the reservation dates does not negate the cancellation fee it would be subject to.
We also recommend purchasing travel insurance separately by selecting "RENTAL GUARDIAN" insurance on our booking page or through this link: https://fariaresorts.rentalguardian.com/ if there is any concern that you will not make your reservation. Please understand: Trip Insurance is non-refundable.
Strict Guest Policy
Please understand that there are NO outside non-paying guests allowed at our Resorts. Our amenities are reserved for paying guests of the resort ONLY. For each guest in your home over the base rate, there is a $25 per day charge during summer peak season and $15 per day at all other times. We allow a maximum of two children under the age of 2 free per reservation. We will be verifying the number of guests in your group upon arrival. If there are more guests in your group beyond what was paid for in your initial reservation, there will be a $50/day per person charge. If we are notified PRIOR to arrival regarding additional guests, there is only the $25/day per person charge during summer peak season and $15/day at all other times. If you have over the allotted guests allowed for the home, your guests will be asked to leave the premises immediately. Sorry, but this is enforced to ensure the resort from overcrowding and our paying guests to have the most pleasurable visit as possible. Thank you for your understanding.
Damage Wavier
A damage waiver is required. This must be received in order to confirm a reservation. No other charges will occur as long as this list is followed:
a. No damage is done to the home or its contents, beyond normal wear and tear;
b. No charges are incurred due to contraband, pets or collection of rents or services rendered during the stay. There is no sign of the home being smoked in;
c. All debris, trash, and discards are placed in the dumpster, and soiled dishes are placed in the dishwasher and cleaned;
d. All charges accrued during the stay are paid prior to departure;
e. NO linens, accessories or items are lost or damaged;
f. NO Early check-in or late check-out;
h. The renter is not evicted by the Owner (or representative of the Owner), the local law enforcement, or the security company employed by Faria Family Resorts.
Smoking
Smoking or vaping is prohibited inside the home and will not be tolerated. Please do not let us discover you have smoked inside the home. If any smoking is discovered, you will be asked to leave the premises immediately and will forfeit the remainder of your rental and deposit. We certainly hope to never encounter such a situation, as we wish to maintain smoke-free units for the enjoyment of everyone. You are welcome to smoke outdoors, but please dispose of all cigarette butts properly. Thank you for your cooperation and courtesy.
Check-In and Check-Out Policies
Check-in time is at 5:00pm. We do not allow early check-ins under any circumstances. The cleaning staff requires the entire time allotted to clean the home. Please check out promptly at 10:00am. There will be a $50 charge deducted from your deposit for every 30 minutes past the 10:00am check out time.
Pets
Pets are NOT permitted in our resort units under ANY circumstances.
INDEMNIFICATION, DEFENSE, AND HOLD HARMLESS
THE INDIVIDUAL EXECUTING THIS VACATION RENTAL AGREEMENT (“RENTER”) REPRESENTS AND WARRANTS THAT RENTER HAS READ THIS VACATION RENTAL AGREEMENT AND THAT RENTER, RENTER’S SPOUSE (IF ANY) AND RENTER’S MINOR CHILDREN (IF ANY) ARE BOUND BY ALL OF ITS TERMS AND CONDITIONS. RENTER FURTHER REPRESENTS AND WARRANTS THAT RENTER HAS PROVIDED THIS VACATION RENTAL AGREEMENT TO EVERY GUEST IN RENTER’S PARTY AND HAS BEEN GIVEN EXPRESS PERMISSION TO EXECUTE THIS VACATION RENTAL AGREEMENT ON BEHALF OF EACH GUEST IN RENTER’S PARTY AND ON BEHALF OF EACH GUEST’S MINOR CHILDREN (IF ANY). RENTER HEREBY AGREES, ON RENTER’S OWN BEHALF AND ON BEHALF OF EACH GUEST IN RENTER’S PARTY, TO THE FULLEST EXTENT PERMITTED BY LAW, TO INDEMNIFY, DEFEND AND HOLD HARMLESS INDIAN TRAILS RESORT, LLC D/B/A WATERMILL COVE RESORT, FARIA RESORTS, LLC, AND THEIR RESPECTIVE AFFILIATES, OWNERS (INCLUDING, WITHOUT LIMITATION, STEVE FARIA AND CONNIE FARIA), PRINCIPALS, MEMBERS, OFFICERS, AGENTS, EMPLOYEES, REPRESENTATIVES, SUCCESSORS AND ASSIGNS (COLLECTIVELY, THE “INDEMNIFIED PARTIES”) WITH RESPECT TO ALL CLAIMS, DEMANDS, RIGHTS, AND CAUSES OF ACTION, LOSSES, DAMAGES, EXPENSES, ATTORNEY’S FEES, PENALTIES, LIABILITIES AND JUDGMENTS OF WHATEVER KIND AND NATURE, INCLUDING, WITHOUT LIMITATION, BODILY OR PERSONAL INJURY AND DEATH, RELATING TO OR ARISING FROM THE RENTAL AND/OR USE OF THE RESORT PREMISES AND AMENTIES, INCLUDING, WITHOUT LIMITATION, THE UNITS, PARKING, POOL, DOCK, LAKE, AND SPORTS AND ACTIVITIES AREAS AND ANY AND ALL RENTAL VEHICLES AND EQUIPMENT. RENTER FURTHER AGREES THAT THIS INDEMNIFICATION, DEFENSE, AND HOLD HARMLESS PARAGRAPH SHALL APPLY EVEN IF THE BASIS OF ANY CLAIM, SUIT, DEMAND, OR CAUSE OF ACTION IS ATTRIBUTABLE TO THE ALLEGEDLY NEGLIGENT ACTS OR OMISSIONS OF ANY OF THE INDEMNIFIED PARTIES. IN THE EVENT THAT ANY GUEST IN RENTER’S PARTY CLAIMS NOT TO BE BOUND BY ANY PROVISION HEREOF, RENTER SHALL INDEMNIFY, DEFEND AND HOLD HARMLESS THE INDEMNIFIED PARTIES AGAINST ANY AND ALL CLAIMS OF SUCH PERSON. THE OBLIGATIONS UNDER THIS INDEMNIFCATION, DEFENSE AND HOLD HARMLESS PARAGRAPH SHALL SURVIVE ANY TERMINATION OF THIS AGREEMENT AND/OR RENTER’S OR THE GUESTS IN RENTER’S PARTY’S STAY ON THE RESORT PREMISES OR USE OF RESORT AMENITIES, WHETHER OR NOT SUBJECT TO EARLY TERMINATION.
SEVERABILITY
If any one or more of the provisions contained in this Vacation Rental Agreement shall for any reason be held to be invalid, illegal or unenforceable in any respect, such invalidity, illegality or unenforceability shall not affect any other provisions of this Vacation Rental Agreement, but this Vacation Rental Agreement shall be construed as if such invalid or illegal or unenforceable provision had never been contained herein. Upon such determination that any term or other provision is invalid, illegal or unenforceable, the court or other tribunal making such determination is authorized to modify this Agreement so as to effect the original intent of the parties as closely as possible so that the transactions and agreements contemplated herein are consummated as originally contemplated to the fullest extent possible.
WAIVER OF JURY TRIAL
RENTER, ON RENTER’S OWN BEHALF AND ON BEHALF OF EVERY GUEST IN RENTER’S PARTY, HEREBY IRREVOCABLY WAIVES ANY AND ALL RIGHT TO TRIAL BY JURY IN ANY LEGAL PROCEEDING ARISING OUT OF OR RELATED TO THIS VACATION RENTAL AGREEMENT.

Most homes have terms and conditions but below are conditions overall for all our homes.
Please note: During peak seasons we have either Friday-Friday, Saturday-Saturday or Sunday-Sunday schedules. During peak season, stays must be 7-nights, 4-nights or 3-nights to follow the schedule

If you arrive with more than the max amount, there will be a $50 per person fee and the additional guests will not be allowed to stay. Sorry, but this is enforced to ensure the resort from overcrowding and our paying guests to have the most pleasurable visit as possible. Thank you for your understanding.
